Legal malpractice may apply when a lawyer loses a child custody case in divorce when the law says that custody is equal if both parents are fit. It is also legal malpractice if the lawyer causes you to get thrown in jail for contempt because of excessive or onerous child support, alimony or equitable distribution orders.

Legal malpractice occurs when a lawyer fails to render competent professional service to a client and the client is damages as a result of the failure.
