violence. Unjust or unwarranted use of force usu. accompanied by fury, vehemence, or outrage; physical force unlawfully exercised with the intent to harm.
domestic violence. Violence between members of a household, usu. spouses; an assault or other violent act committed by one member of a household against another. See BATTERED-CHILD SYNDROME; BATTERED-WOMMAN SYNDROME.
assault, criminal law. An attempt to commit battery, requiring the specific intent to cause physical injury.
....so if the alleged victim (corpus) believes incident to be an accident and or an accused can prove an alleged incident to be an accident, then the alleged victum and or state is without a case in law from which relief can be granted, frivolous and or vexatious; found without standing and lacking corpus delicti, the body of the crime, the criminal agency of some person (i.e., not mere accident).
Private for profit public service/servant(s) require an assignment "true claim" before acting in public (public capacity); creating dejure tort law.... Police and prosecutors act by assignment "calling emergency services like 911" from alleged victim (rights) initiating public performance concerning the injury claimed (original incident report).
Acting at law, without this said assignment, and or evidence on the record of a crime, in law "mala in se" i.e. murder (corpse) anything else is treason to the constitution(s), a breach of trust and or performance agreements/contracts/oaths of office(s).... period "tortfeasor(s)"; when a police officer, whom acting on his/her own without an assignment and or dejure tort, makes an arrest, this arrest is merely a citizens arrest (private capacity) arresting officer him/her self bringing the claim, must then prove him/her self injured to have a "de jure" suit in law.
