US code Title 42.chapter 7> subchap IV> part D> 666 Lets the states automatically garnish you don't even have to miss a payment. Title 15> chap. 41> subchap. II> 1673(b)2 Says the state can garnish 50 - 65% of disposable income www.leg.state.nv.us/NRS/NRS-031.html#NRS031Sec295This NV s law and it says 50% if you have an other wife or kid and 60% if you don't. As much as I'd love to see you kick some ass, I think you'd have to change or eliminate the Brady act. And they're not going to give up that golden goose. At least they numbered it correctly, 666. You can help your self and others by getting active in the movement to change the system, child support, custody and courts all need an overhaul, as you can see. So the only way to stop garnishment is slim 1 you have to be current for the past 12 mo. and request a hearing through enforcement 2 you have to show it to be "in the best interest of the child" 3 Enforcement must agree. Sorry I couldn't find a better answer. And I know these tyrannical bastards have steam rolled our civil and constitutional rights, but until we can hold them responsible for their actions no good will come of it. Its to my understanding that the actual case would have to be closed with CSE. There may be other motions you could pursue, but I doubt it. You would have to study the state code and procedures with them.

Jay: Yes, after 12 months of compliance, you can appeal with a hearing. I'm sure that it's probably not worth the effort. You won't get anything back unless it's overpayed, and then it's pretty slim pickins. Harrison

the good news is that my child support case manager is not a total bitch she told me the month that i am going to make my final payment to contact their office and they will send the wage garnishment letter out so they stop taking money from me.

What they say and do are two different things, but if she comes through for you that's great. It would be the first time I seen them drop anything willingly.
