Indiana Senate Bill 560, introduced on 20 January 2009, is sponsored by Senator Dennis Kruse of Allen County. Although we have not worked with Senator Kruse in the past we are plase to see him join his fellow legislators in his area, Representatives Pond and Bell, in supporting Shared Parenting. The complete text of the Bill is below.
SB 560 provides that in actions for child custody in a Dissolution of Marriage proceeding a judge is to presume that both parents are fit to maintian their authority to make the legal decisions regarding the upbringing of their children as well as continue physical custody. Legal custody includes controlling the medical care decisions, education and religious training.
This bill includes nearly all, of the provision which we sought in our 2007 Shared Parenting proposal. Feminist groups have strongly opposed any legislation that would cut away from the substantially disproportionate findings by Indiana courts that generally only women are qualified and able to provide the care, companionship and upbringing of children and to make rational decisions regarding their medical care, education and religious training.
