Our son started his divorce at 20 years old, Bates County, Missouri. Over the first 2 years he had pictures of neglect from almost every visit with his daughter. They ranged from a burn on the child's leg to diaper rashes that were so bad they had blistered. He called social services and was told not once but on 3 different occasions there was nothing he could do and they could not help until his divorce was done it would be looked at as a spiteful call and not taken seriously. As time progressed he had called his attorney several times and was told to just return the child to the mother and they would deal with it the next time he went to court, finally a call was made to the sheriff's department and an officer told him to keep the child away from the mom, contact his attorney and have the judge informed that his daughter was not being returned due to extreme neglect; when this was done he was informed by his own attorney that he will be put in jail. The best they could do was to show the pictures to the judge. The judge was shown a couple of pictures 9 months after he was threatened with jail, A GAL was requested by our son, and shown the pictures and notes from every visit over the last 2 years and a doctors exam as well, the mother was told in court by the judge to learn how to care for her now almost 3 year old baby and the father was informed not to bring this back into the judges court room or he would find all his rights and visitation taken away permanently. The guardian ad litem told the father there was nothing she was willing to do since nobody had given fathers the kind of time he was requesting and she would not be the one to start doing so now. Each attorney, judge, state worker, and GAL had been turned into the state of Missouri for neglecting to protect a child from such gross negligence, believing, by the attorney helping file these papers this was an ethical issue, the state ignored all the evidence and said it may have been bad judgment but had nothing to do with ethics or breaking of the laws that were there to protect the children in this state. We have been trying to help our son (and several of his friends with the same kind of nightmare stories) find someone to fight this in the Missouri supreme court. We have verbally tried to help these young parents by giving them hope that by continuing to fight they will be heard and that not all the judges and attorneys are crooked. While we try to keep giving mental support, their kids are growing up without them and the other parents are getting away with an amazing amount of abuse and neglect. Each fit parent should have 2 weeks each no matter how it is divided up each month. However we have yet to find an attorney to take this on for so many dads as a discrimination law suit and just keep being told it isn't really discrimination, and gotta love the no response that comes from 90% of law firms. In theory a law firm could just take $100 from each parent they represent and make this a class action suit against the state, giving the firm the money they need, dads proper representation in court, and some hope, and the law firm a great deal of free publicity. My theory so far only works in my head, if you know someone who might do this let me know.

This is another sad story of injustice among thousands if not millions. Your ideas are good but lawyers make more money prolonging the agony rather than trying to find solutions to it. I get frustrated and angry about the whole judicial system that I think is a crock. We do know and have told all these guys including our son to watch their P's and Q's because they are men and will go to jail in a NY minute. You may capitalize anything you want. It's your web page and it doesn't bother me. Thanks

Debtors prison is really getting crowded now with the way the economy is. The judicial system is really out of control.

Hey I know exactly what you are talking about! We are in Jackson county, MO where they have their own charters. My daughter has a child now almost 5 and she has had problems with the father for years. Abuse, we had pictures of bruises on her body, she claimed and even told a DFS worker in a room alone, and a psychologist she was seeing that he had touched her, she was then nearly 3 yrs old. The child's father disappeared for 3 mos and would not call my daughter, and she got served with a family motion for access. The Commissioner hearing the case, not a Judge believed every word he said and punished my daughter. It happened again a year later. Then last summer he filed a motion to modify asking for sole custody, which resulted in a 3 day trial in Feb of 08, blaming mostly me for alienating him for his child (my daughter lives at home) my husband and I have to leave our home when he comes to pick the child up and return her. He got a large amt of extra time, and 2 mos in the summer! The GAL, his attorney and the Commissioner we believe are in this little "country club". The GAL and the father stated that I was crazy and emotionally unstable! And now after nearly a yr that the court order was done, he has only kept her 2 weekends, he has every excuse in the book not to come pick her up when he has her on Tues and Thurs. He was supposed to pick her up on Fri evening for Memorial Day and keep her until Memorial Day evening. He did not call or show up. My daughter has to turn him into child support enforcement every time he quits a job and gets a new one. He does not want to pay the measly amt the court ordered. We are thinking of taking him to court and filing a motion to modify due to disinterest and try to get sole custody for my daughter, we have the best custody lawyer in MO. but not sure if we even have a case, guess we will see what he says. So all of these men on the board that claim to be the victims, I wish I knew what state that was in. Here in Missouri, it is the Mother who has no rights, not to mention the poor children who are abused by the Fathers!
