I am willing to go as far i can.I know me living her is what is hurting my case and all,I want to come back down and deal with this shit so bad.However with me living homeless would be the kick in the balls for me.Plus i mean thank u framed and berta for willing to help.I am so glad i meet this site and as for the people; on her.U are the best,I am still thinking on what to plan.I mean i did have one and then the money issue fell there.Cause i will fight until they are grown if i have too.ARe if i am died because of this

I really think that you should consider relocating back to where your children are. You may have to get 2 jobs to do it. Your children have the right to be with you at least as much time as they spend with her. Are your parents alive? Can you live with them until you get on your feet financially a little better? Sometimes judges favor father's with a supportive family behind the father. If you want to parent you need establish yourself as a responsible parent. Get involved. I don't know how much a court is going to think you are involved if you live in different states. Establish yourself as a reliable, dependable parent. If your children are young or about to be attending school, try to volunteer whenever possible, i can't stress it enough! Document the times and activities you involve yourself in with your children. Actually DOCUMENT EVERY THING!! Dates etc... notes on when she refuses you access. Request them if you want them....let her deny you....then document. My parents are alive and i have ask them to live with them.However my sister and her kids live there plus my brother and my baby sister,My parents are not a option due to the drugs and drinking that they do,SO if i was come down that is a not a option to choose,Cause my wife know this and will use it against me.And so me having a place to stay on my own is the best option for me.As for me documenting everything,I do all the time.

I would really like to see all that paperwork. I just helped a father prevail in obtaining his children's school records after he initially was sent the most insulting letter denying him access. Within 10 days after sending the next letter, he obtained his children's records to include a nice letter from the school this time. The process does work and The Dept. of Education's, Office of Compliance does step-in and protect your FERPA rights. I can only think you must not have gone about the request with all your t's crossed and i's dotted.
Do you know anyone with access to a fax machine so you can fax me all the paperwork regarding your efforts to assert your FERPA rights? I am confident I can help you prevail with this. Maybe you could place an ad on Craiglist asking that someone donate a scanner for the sake of your children. Some people's trash is another's treasure. Certainly doesn't hurt to try.

Do you have any temporary custody/visitation orders in place, temp. consent orders pertaining to visitation/parenting plans? anything ? The only order that is in affect is a RO order form the pending charge,And then there is the temp vistation order. That states that i am to get them the 1 and 3 weekend and on those days i have to pick the kids up at 6 and drop them off on sunday at 6.I get them every other year for thanksgiving and for half the day and and the same for christmas and all.And for summmer i get them 2 weeks and she gets them for 2 weeks and i get them back for 2 weeks. So that is the only orders that i have,But i do not have the paperwork at all.And have no money to pay for copys and all.And no friends that are willing to go and get copys for me

Every letter (all paperwork) you have sent and have received having to do with getting your children's school records....all of your requests for records, the school's denial letters, your complaint to the Education Office of Compliance and their response back to you.

Especially when your suppose to have your kids for a couple weeks in the summer......If your wife already suspects this she can stop these visitations with a court action. I dont mean to sound rude but this is basically what a Judge will ask you. I'm sure your wife already has this kind of game plan laid out to slam you with. The Judge will want to know how you expect to afford to transport them back and forth too. Personally I feel the only way your going to be able to accomplish anything is to move closer to the kids and get steadily involved with your kids and proactive with your case. Just by what you have told us so far, it doesn't sound very good at all and your personal and financial situation will play against you bigtime.

I never receive a letter back from any school.All of them stated they cannot assist me giving the info and that was when i called them after the 45 days has passed.Then Family compliance office states to me over the phone that i must send a sec letter to them and then when i do no a damn thing is done.

Your mistake has been verbal communication....that's why you haven't prevailed in obtaining your children's records. Everything must be done in writing. You have no evidence to support a complaint to the Office of Compliance. I'm surprised you were able to talk to someone over the phone.
In order to succeed with obtaining your children's records, you must make the request to the school in writing and provide proof of parentage and identity. This letter is sent by certified mail proof of delivery. I have a standard letter I am happy to share with anyone. According to federal law, the school has 45 days to comply. Trust me, the school will comply. If not, you make a complaint against them. In the end, you will prevail as long as there is no court order which specifically states that you are denied access to your children's records.
I have a great success record with this, trust me.

I did write the school and after 45 days i call the school and then call the family compliance office and then they called the school and spoke to them and then FC officer called me back and said i had to start over again.By sending a certified letter and i cannot afford that and then wait another 45 days and so on and so on.As for parentage and identity,I have no money to get copies of BC and SS Cards.

If you get a chance BertaSue, could you email me a copy of the standard type of letter your useing for Ferpa request. I've heard you talk about it a bit but have never actually seen it. I would like to check out the language in it and keep a copy in my records.
I may actually need to use it myself. Thanks.
